Abstract

The article entitled “Damage as a fundamental element of state liability” aims to provide the reader with a brief description of the importance of demonstrating the damage caused by the state in order to request compensation as part of its non-contractual liability. For this article, a bibliographic review of some doctrines issued by different authors and jurisprudences outlined by the Supreme Court of Justice was carried out, where we can observe that it is also necessary to demonstrate the causal relationship of this damage resulting from the existence of culpable or negligent conduct by the State.

    Servidor público (durante más de 20 años) -  Instituto Panameño de Turismo, Contraloría General de la República.  Abogado - Procuraduría General de la Nación (Departamento Legal de la Secretaría Administrativa).  Abogado y Licenciado en Administración Pública, con Maestría en Administración de Negocios con énfasis en Finanzas y Maestría en Derecho Administrativo.   Postgrados en Alta Gerencia y Docencia Superior.  Diplomados en Gerencia Internacional y Gestión Pública con énfasis en Contrataciones Públicas.

    Docente universitario, cátedras de Derecho Administrativo I y II, Hacienda Pública, Teoría de la Administración Pública y Gestión Pública por Resultado I y II.
