Analysis of the violation of bioethical principles in human cryopreservation

Cryogenization involves preserving the body of a deceased individual at low temperatures with the aim that, in the future, the body may either be fully revived or the brain transplanted into a robotic body. This research aims to analyze human cryopreservation from a bioethical perspective, referencing the legal case FD16P00526 (United Kingdom, 2016), which authorized the cryopreservation of a 14-year-old girl’s body. A qualitative, documentary, and case study approach was employed, with an interpretative focus. Academic and legal sources were reviewed, and a critical analysis was conducted based on the bioethical principles of autonomy, beneficence, non-maleficence, and justice. The analysis revealed respect for the patient’s autonomy but also highlighted the lack of scientific support, which undermines beneficence, concerns about non-maleficence arose due to the manipulation of the corpse, and justice was clearly violated by the high costs and unequal access to cryopreservation. While human cryopreservation respects individual will, it raises significant ethical and legal dilemmas that necessitate international regulation. The study offers a critical reflection on the importance of safeguarding post-mortem dignity and establishing normative frameworks to ensure compliance with bioethical principles in emerging scientific practices.
